Agreement to Terms

FleetSetu is an initiative by SparrowBytes FinTech Solutions Private Limited. By accessing or using FleetSetu's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access our services.

These terms apply to all visitors, users, and others who access or use our fleet and logistics management platform. All regulations, terms, and policies of SparrowBytes FinTech Solutions Private Limited are additionally applicable to FleetSetu services.

Use License

Permission is granted to temporarily access and use FleetSetu's services for personal or commercial purposes in accordance with these terms. This license includes:

• Access to fleet management and logistics automation tools
• Use of API integrations for business operations
• Real-time tracking and monitoring capabilities

Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to our services. We reserve the right to modify or discontinue services with reasonable notice to our users.

FleetSetu will not be liable for any interruption of service due to maintenance, updates, or circumstances beyond our control.

User Responsibilities

As a user of FleetSetu services, you agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Use the service in compliance with all applicable laws
• Not attempt to gain unauthorized access to our systems

WhatsApp Communications

Where the platform is configured or used for this purpose, you may receive communications from FleetSetu, or from a business using FleetSetu, over WhatsApp. These messages may include transactional, operational, account, support, reminder, notification, or other service-related communication. Promotional or marketing messages over WhatsApp will only be sent where permitted under applicable law and subject to the required consent or opt-in.

You are responsible for providing a valid and correct mobile/WhatsApp number, and for ensuring that you are authorised to provide the number used for receiving communications. WhatsApp is a third-party communication service operated by WhatsApp/Meta, and we cannot guarantee its availability or the delivery of any message sent through it. Delivery can be affected by factors outside our reasonable control, including WhatsApp/Meta's systems, telecom provider issues, internet connectivity, the recipient's device or account settings, number status, message template approval, and platform restrictions. FleetSetu will not be responsible for delays or non-delivery caused solely by such third-party communication infrastructure.

If you no longer wish to receive applicable WhatsApp communications, you may request this using the contact details below, subject to communications that are transactional in nature or that we are legally permitted or required to continue sending.

For businesses using FleetSetu: if you use FleetSetu to send WhatsApp communications to your own customers, vendors, drivers, employees, or other recipients, you are responsible for ensuring you have the necessary authorisation, consent, and lawful basis to do so before sending such communications through the platform. FleetSetu provides the platform and underlying WhatsApp Business Platform connectivity; it is not responsible for the content of messages sent by a business using the platform, or for that business's compliance with consent requirements applicable to its own recipients.

Data Privacy & Security

FleetSetu is committed to protecting your data. We implement industry-standard security measures to safeguard your information. For detailed information about how we collect, use, and protect your data, please refer to our Privacy Policy.

You retain ownership of all data you input into our system. FleetSetu will not share your data with third parties without your explicit consent, except as required by law or as reasonably necessary to deliver a communication or service you have requested — for example, passing a recipient's number and message content to WhatsApp/Meta when a communication is sent over WhatsApp, as described above.

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice to existing customers.

Limitation of Liability

FleetSetu shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the platform. Your continued use of the service after such modifications constitutes acceptance of the updated terms.
